Data
Information that is:
- Processed on computer
- Recorded with the intention of being processed on computer
- Recorded as part of a relevant filing system (or intended to form part of)
Data Controller
Someone who determines the purpose and manner in which personal data can be used. (Usually the firm).
Note: If data is required to be processed by law, eg Parish required to collect data on its parishioners under the rates law, then the Parish becomes the Data Controller as it is the Parish upon whom the obligation is placed.
Data Processor
Anyone who processes data on behalf of the Data Controller. (Eg. Consultant).
Does not include an employee of the Data Controller. They form part of the Data Controller.
Data Subject
The individual to whom the personal data relates.
Personal Data
Information relating to a living individual, who can be identified:
From the data; or
From the data or other information in possession of the Data Controller (or likely to come into possession of the Data Controller).
Includes expressions of opinion and indications of the intentions of the Data Controller.
Sensitive Personal Data
Personal Data relating to the individual which includes:
- Racial/ethnic origin;
- Political beliefs;
- Religious beliefs;
- Trade Union information;
- Physical or mental health condition;
- Sexual orientation/life;
- Commission/alleged commission of criminal offences;
- Criminal proceedings and sentences.
Processing (of information)
- Obtaining, recording or holding data
- Carrying out operations on the data, including:
- Organising, adapting or altering the data;
- Retrieving, consulting or using the data;
- Disclosing data by transmission, dissemination or otherwise;
- Aligning, combining, blocking, erasing or destroying the data.
Inaccurate
which is incorrect or misleading as to any matter of fact.
Relevant Filing System
Relates to manual records only.
Structured by way of:
- Reference to individuals;
- Reference to criteria relating to individuals in such a way that specific information relating to the individual can be readily accessible.
Special Purposes
The Special Purposes are:
- The purposes of journalism;
- Artistic purposes;
- Literary purposes
Subject Information Provisions
The subject information provisions means:
1) The first Principle, in so far as the Data Controller should ensure as far as possible that:
- The Data Subject has been provided with the specified information, or it has been made readily available to him; or
- The Data Controller must ensure that, before the relevant time, or as soon as possible after that time, the data subject is provided with the specified information, or it has been made readily available to him.
2) Article 7 of the Law, relating to an individuals right of access to Personal Data.
Third Party
Anyone other than the data controller, data subject or data processor.
Non-Disclosure Provisions
The sections of the Law which prevent a Data Controller from disclosing information outside the scope of his registration.
Note: Exemptions may apply, for example, the Police would be exempt from the non-disclosure provisions if the disclosure was for the purposes of the investigation of a crime.
Direct Marketing
Communication by whatever means of any advertising material, or marketing material, which is directed to particular individuals.
Registrable Particulars
In relation to the Data Controller, means:
- Name and address of the Data Controller;
- Name and address of representative of data controller, if the Data Controller is outside of Jersey;
- Description of the Personal Data to be processed and the categories of data subject to which they relate;
- Purpose for which data is being held;
- Who it will be disclosed to;
- Territories to which it may be transferred;
If the Data Controller holds data in both manual and electronic form, they must notify us that they hold manual data that is assessable.
